Here’s the beef that some have about the real estate business as shown in the following story. Real estate brokerage entails some components that the public is not always aware of. In 1974 my brother wanted to purchase his first home and had saved his pennies. We stopped into a local real estate brokerage. It was typical of the era. It was a “seller agency” exclusively as “buyer brokerage” did not happen back then. The practice at that time did not offer buyer representation, it was caveat emptor – buyer beware. There were pictures and small descriptions of the listed properties on the wall. He spotted one on the Shawsheen River, in Billerica, Massachusetts and eventually purchased it.
This broker stood out to me. She was jovial with an edge. I had the feeling that she was not being forthright and seemed evasive when viewing the property. She was way hot to make a deal. (Of course.) It was only after taking the Introduction to Real Estate course, a prerequisite to obtaining a real estate license, that I began to understand her behavior. It was then that I learned about the law of agency, required disclosure, what you can and cannot say, and advice was not free. That is, we are bound not to provide real estate related advice unless there is a written agreement to represent the buyer, or seller for that matter. It gets tricky, sticky, and dicey at times.
